TERMS AND CONDITIONS

These Terms and Conditions apply to purchases made through RICHTHAIPHOTOGRAPHY, operated by RICHARD THAI ("we", "us", "our"). By purchasing, downloading or accessing any digital product from RichThaiPhotography, you agree to these Terms.

1. Digital Products We sell digital photography products including, but not limited to:

  • Lightroom presets;

  • preset packs;

  • photography guides;

  • ebooks;

  • tutorials;

  • digital downloads;

  • educational resources; and

  • other photography-related digital content.

Digital products are supplied electronically and may be delivered by download link, email, customer account or another digital delivery method.

2. Personal Licence When you purchase a digital product, you are purchasing a personal, non-exclusive, non-transferable, revocable licence to use that product for your own personal photography and creative work. Your purchase does not transfer ownership or copyright of the digital product to you. You may use purchased presets and other resources on your own photographs and creative work, subject to these Terms.

3. What You Cannot Do Unless you have received our prior written permission, you must not:

  • share, distribute, forward, sell, resell, sublicense, rent or lend the digital product to another person;

  • upload the digital product to a website, file-sharing service, cloud storage folder accessible by others, social media platform or online community;

  • give your download link or account access to another person;

  • reproduce, duplicate, copy, redistribute or republish the digital product;

  • make the digital product available for download by others;

  • claim the digital product or any part of it as your own work;

  • modify, reproduce or repackage the digital product for the purpose of selling or distributing it;

  • use any part of the digital product to create a competing product for sale or distribution; or

  • remove copyright notices, branding, watermarks or other ownership information.

This restriction applies whether the product is shared for payment, free of charge or in any other way.

4. Presets Lightroom presets and other editing tools are licensed for use by the purchaser only. You may apply presets to your own photographs and use the resulting edited photographs for personal, portfolio, social media and commercial photography purposes, unless otherwise stated on the relevant product page. You may not distribute, sell or otherwise make the preset files themselves available to another person. For the avoidance of doubt, purchasing a preset does not give you permission to distribute or sell the preset file itself.

5. Photography Guides and Educational Materials Photography guides, ebooks, tutorials and other educational resources are provided for the purchaser's personal educational use. You may refer to the materials while developing your own photography skills and techniques. You may not reproduce, republish, distribute, upload or commercially exploit the materials or substantial portions of them without our written permission.

6. Copyright and Intellectual Property All digital products, including their text, photographs, graphics, designs, presets, instructions, layouts, videos, branding and other original content, remain the intellectual property of RichThaiPhotography and/or their respective rights holders. All rights not expressly granted under these Terms are reserved. Nothing in these Terms transfers copyright or ownership of any digital product to you.

7. Copyright Infringement and Unauthorised Sharing We actively protect our intellectual property. If we reasonably believe that a digital product has been copied, shared, redistributed, resold or otherwise used in breach of these Terms, we may:

  • suspend or terminate access to the relevant product;

  • revoke the relevant licence;

  • disable or cancel associated download links;

  • restrict access to future purchases;

  • request that the unauthorised material is removed;

  • issue a copyright or intellectual property infringement notice; and/or

  • take further legal action where appropriate.

Where appropriate, we may use purchase records, order information, download records and other reasonable technical information to investigate suspected unauthorised distribution.

8. Download Links and Access Download links and access credentials are intended only for the purchaser. You are responsible for keeping your purchase information and account credentials secure. If you believe that your download link or account has been compromised, please contact us at richthaiphotography@gmail.com. We may limit or revoke access where we reasonably believe that access is being misused or shared in breach of these Terms.

9. Product Compatibility Product descriptions will state any relevant compatibility requirements where applicable. You are responsible for checking that your software, operating system and equipment are compatible with the product before purchase. Where reasonably possible, we will provide information about supported software versions and file types on the relevant product page.

10. Results and Personal Preference Photography presets and educational products are provided as creative tools and educational resources. Results may vary depending on the photograph, lighting conditions, camera, lens, exposure, white balance and other factors. We do not guarantee that a preset or guide will produce a particular aesthetic result on every photograph.

11. Pricing and Availability We reserve the right to change product prices, discontinue products or modify product offerings at any time. Any price change will not affect an order that has already been completed.

12. Return and Refund Policy Because our products are digital products, including but not limited to Lightroom presets, photography guides, ebooks, tutorials, digital resources and downloadable files, purchases are generally non-refundable once the digital product has been downloaded or access has been provided.

Digital Products Acknowledgement Before completing your purchase, you will be asked to acknowledge that:

  • you are purchasing digital content;

  • you request that the digital content is supplied immediately after purchase; and

  • once delivery or downloading of the digital content begins, you understand that you lose your statutory right to cancel the purchase under applicable UK consumer law.

Accordingly, once you have accessed or downloaded your digital product, we do not generally accept returns or provide refunds simply because you have changed your mind.

Faulty or Defective Products Your statutory consumer rights are not affected by this policy. If a digital product is faulty, corrupted, does not match its description, or does not function as reasonably expected, please contact us at richthaiphotography@gmail.com as soon as possible. Where appropriate, we may provide a replacement file, corrected version, reasonable technical assistance or, where required by law, a refund.

Accidental Purchases Please review your order carefully before completing payment. We do not generally provide refunds for accidental purchases once digital content has been accessed or downloaded, except where required by applicable law. If you believe you have purchased a product in error, contact us before downloading or accessing it and we will consider your request.

Duplicate Purchases If you accidentally purchase the same digital product more than once, please contact us at richthaiphotography@gmail.com. We may, at our discretion, refund a genuine duplicate purchase where the duplicate product has not been accessed or downloaded.

Refund Requests Any refund request should include:

  • your name;

  • the email address used to make the purchase;

  • your order number; and

  • a description of the issue.

We reserve the right to request reasonable evidence of a technical problem before issuing a refund or replacement. Nothing in this policy limits or excludes any rights you have under applicable consumer protection law.

13. Limitation of Liability Nothing in these Terms excludes or limits liability where doing so would be unlawful. Subject to that, we will not be responsible for losses that are not reasonably foreseeable or for losses arising from circumstances outside our reasonable control.

14. Changes to These Terms We may update these Terms from time to time. The version applicable to your purchase will generally be the version in effect when you completed your order, unless a change is required by law.

15. Governing Law These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that apply to you.
